Version 2026-10-14. Effective 14 October 2026 for new agreements and offers governed by this version. Existing paid rights and accrued claims remain protected; a revised agreement that requires new acceptance applies after the required notice and acceptance. The full terms below apply to the Emblem app, website and ordinary cultural-passport services. A negotiated written agreement may expressly govern a particular business project. Campaign-specific rules apply to their campaign, subject to mandatory law.
1. Who provides Emblem
Emblem is provided by Emblem: Digital Souvenirs S.à r.l.-S, registered in Luxembourg under RCS B294391, with its registered office at 19 Rue de l'Industrie, L-8069 Bertrange, Luxembourg. In these terms, “Emblem”, “we”, “us” and “our” refer to that company. Our website is https://emblemdigitalsouvenirs.com/. Contact us at danielmichels@emblemdigitalsouvenirs.com.
“You” means the person using the service. A consumer is a person acting mainly outside their trade, business or profession. Provisions expressly limited to business users do not apply to consumers.
2. Agreement, notices and particular offers
We make these terms available before account registration or the relevant order. You must accept them to complete account onboarding or place an order governed by them. A technical account or profile can be created before the onboarding acceptance step; that creation alone is not recorded as your acceptance. Acceptance forms the corresponding agreement. Browsing a public page alone does not establish consent to optional personal-data processing or waive statutory rights. The Privacy Policy explains data processing; acknowledging receipt of that policy is separate from accepting these terms and from optional consent choices.
The description, price, currency, taxes, duration, renewal conditions, eligibility, device requirements and other material limits displayed for an offer form part of that offer. Save your order confirmation and the terms supplied with it. We do not replace specific paid-access promises with a general right to remove access at will.
If you act for an organisation, you must have authority to bind it. We can require evidence of that authority. No partnership, endorsement, exclusive territory, funding commitment or licence to another party's rights is created merely by a profile, proposal, discussion or listing.
3. Age and account responsibility
The service's minimum registration age is 13. This service floor does not override a higher local legal requirement, a campaign age limit, a payment restriction or the age at which a young person can provide their own valid consent. If you are under 18, obtain a parent or guardian's involvement where required for your use, purchases and participation. Do not provide a false date of birth or claim to be a guardian without authority.
We may request proportionate information to check eligibility and may restrict features where age or required authorisation cannot be established. An in-app content-filter PIN is not proof of parental authorisation. Where the law requires verified guardian consent for optional data processing, a general acceptance checkbox is insufficient.
Provide accurate registration details, protect sign-in credentials and promptly report suspected account misuse. You are responsible for activity you authorise; you are not automatically responsible for losses caused by our security failure or other matters for which the law places responsibility on us. Do not sell, rent, share or transfer an account. Use supported gifting and account-recovery features instead.
4. Licence to use the service
Subject to these terms, we grant you a limited, non-exclusive, personal licence to use the app and supported features for their intended purposes. Business deployment, commissioned artwork, private or bulk API access outside published interfaces, and commercial exploitation require an applicable written permission or agreement. Ordinary use of documented public catalogue, MCP or WebMCP interfaces is allowed under their published access rules; it does not authorise private-data extraction or use outside those rules.
You may use the sharing, download and gifting features we provide within their stated limits. This licence does not transfer ownership of software, trademarks, artwork, music or another user's content. Do not resell access, scrape personal data, circumvent access controls, remove attribution, distribute unauthorised copies or reverse engineer the service, except where a mandatory legal exception allows the particular activity. Outside documented public interfaces and their access rules, automated bulk extraction, building a competing catalogue from protected service content, or using that content to train a model requires our written permission and any necessary contributor permission. Linking to public pages and ordinary authorised search indexing remain permitted. We may use proportionate access limits to protect availability, personal data and licensed content.
5. Collection, geography and visits
Emblems are digital souvenirs associated with places, stories, cultural experiences or other described activities. Official curated Emblems are distinct from user-created People, Event or Community content. A user profile, map entry or membership badge does not by itself certify identity, approval by an institution or the accuracy of a contribution. A collection can depend on device location, eligibility, timing, availability and a successful server check. We can reject manipulated, duplicate or otherwise invalid collection attempts and correct records resulting from error or fraud.
A map marker, GPS check or digital collection does not grant physical entry, an admission ticket, a right to trespass, access to a private property or permission to ignore safety restrictions. Check opening hours, accessibility, travel conditions and any venue charges with the responsible operator. Do not operate the app while driving or enter unsafe or prohibited areas. We do not control third-party venues or guarantee GPS precision, connectivity or uninterrupted access, while retaining our obligations for the digital service we supply.
“Territory” describes a geographic or cultural area. Names, maps and participation do not express a position on political recognition, boundaries or sovereignty.
6. Standard Emblems, Coins and paid passports
Standard Emblems are service-based digital souvenirs, not an investment, legal title to a physical place, cryptocurrency or a promise of financial return. The collection entry and permitted use are distinct from copyright in its underlying content.
Coins are in-app credits for uses described in the app. They have no cash-redemption value, cannot be transferred outside supported features and do not expire. A purchased Coin package has the amount and price shown at checkout. We may correct an erroneous balance or reverse credits for a refunded, cancelled or fraudulent transaction, with notice and a way to challenge the correction where appropriate. We will not confiscate properly purchased credits merely because we change these terms.
A paid passport described as giving permanent access on your account remains available in accordance with that promise. “Permanent” is not a promise that every device, third-party venue or individual piece of licensed content will exist forever. If a material part of a paid service must end or become unavailable, we will explain the reason and provide the remedy required by the offer and applicable law, including an appropriate refund when required.
Any separately offered blockchain collectible or experimental wallet service requires specific, advance disclosures and additional terms. These ordinary-service terms do not authorise undisclosed public-chain uploads, asset custody, charges or irreversible transactions. A standard Emblem does not become a blockchain asset simply by being collected.
7. Purchases, billing and refunds
Use only the payment channel shown for the offer. Apple or Google purchases are billed through the relevant store account; the store's applicable billing processes also govern. We do not receive the full payment-card details used for those store purchases. A separate website or physical-goods checkout must identify its merchant, price and payment conditions before purchase.
Contact the store through its refund process for a store-billed purchase, or contact Emblem with the order reference if you need help or have a claim against Emblem. Do not send full card details, passwords or authentication codes. Store procedures do not remove mandatory rights against the responsible trader. A blanket “no refunds” rule does not apply.
If digital content or a service is defective, not supplied or inconsistent with the contract, you retain the applicable rights to have it brought into conformity and, where the legal conditions are met, to a price reduction or termination and reimbursement. We may require reasonable evidence of the order and issue; we do not shift the trader's statutory burden of proof to you.
8. Membership subscriptions
Membership is available only where an offer is displayed. Before you subscribe, the purchase screen must show the price, billing period, included benefits, renewal conditions and any trial or introductory price. An auto-renewing subscription renews for the displayed period until cancelled through the store account used for purchase.
For Apple-billed subscriptions, use Apple's subscription settings and follow the renewal deadline shown for your offer and country; Apple advises cancelling a trial at least 24 hours before it ends. For Google Play, cancel before the renewal date shown by Google. Country-specific store rules and mandatory cancellation rights remain applicable. Manage or cancel through the store's subscription settings. Deleting the app or your Emblem account does not by itself cancel store billing. Restore eligible purchases through the supported restore function using the appropriate store account.
Cancellation normally prevents the next renewal while access continues for the remaining paid period, subject to refunds or other legal remedies. A membership mark identifies membership, not verified identity. Campaign benefits, including any Lucky probability increase, are subject to the published campaign rules; there is no guaranteed win and probabilities cannot exceed 100%.
9. Consumer withdrawal
Where applicable, consumers have 14 calendar days from conclusion of a service or non-physical digital-content contract to withdraw without giving a reason. The relevant offer must explain whether an exception applies. Merely accepting these terms, acknowledging the Privacy Policy, using the app or buying Coins is not a blanket waiver.
For paid digital content delivered immediately, loss of the withdrawal right requires your prior express consent to begin performance during the withdrawal period, acknowledgement of the resulting loss, and the required contract confirmation on a durable medium. For a service started during the period at your express request, only the proportionate charge permitted by law may apply; the applicable conditions differ from those for digital content. If those conditions have not been met, we do not rely on a waiver that did not occur.
Send an unambiguous withdrawal notice to danielmichels@emblemdigitalsouvenirs.com, or to our registered office. You can use the optional model form in Appendix A or any other clear statement of withdrawal. No particular form or account-deletion request is required. Where reimbursement is due, we will arrange it within the applicable statutory period, normally 14 days after notice, using the original payment method unless you expressly agree otherwise, without cost to you.
The current direct withdrawal route is the contact address above; for a store-billed purchase, the store also provides its applicable request process. We do not describe account deletion or subscription cancellation as an online withdrawal function. Where your purchase channel and applicable law require a dedicated online withdrawal function, that additional function must be prominently provided throughout the relevant withdrawal period, with identification of the contract, review and express confirmation of withdrawal and an acknowledgement on a durable medium without undue delay. The absence of such a function does not remove your statutory rights or your right to send any clear withdrawal notice. Cancelling future subscription renewal is separate from withdrawing from a purchase.
10. Rewards, competitions and third parties
Each campaign must identify its organiser, participation period, eligibility, entry conditions, selection method, reward, redemption restrictions and any sponsor terms. Those rules are supplied before entry. A purchase is not a guarantee of a reward. Membership effects apply only as the particular rules permit. Apple and Google are not sponsors unless an expressly verified statement says otherwise.
We may reject invalid entries, correct technical errors and disqualify proven cheating under the campaign rules. We will not retrospectively alter a completed campaign to deprive an eligible participant of an earned benefit. Mandatory law takes priority. Local legal eligibility must be checked before a campaign is offered; these terms do not create a worldwide authorisation to run a lottery or prize promotion.
External venues, links and providers can have their own rules. We identify any responsibility we undertake. We remain responsible for our own service and cannot exclude a legal obligation merely by naming a third party.
11. Intellectual property and creator agreements
Emblem retains its rights in the software, service design, brand and content it owns. Other contributors retain rights they have not transferred or licensed under a valid agreement. An institution's involvement does not automatically give it ownership of commissioned art or music. Collecting, purchasing or gifting a digital souvenir does not transfer copyright or imply an exclusive licence.
Creator and institutional projects require a written agreement identifying deliverables, approval, credits, scope of rights, permitted adaptations, music and performance clearances, remuneration, payment milestones, duration, territory and any termination rights. These user terms do not replace those project agreements or acquire rights the contributor cannot grant. Mandatory moral rights and valid third-party licences remain applicable.
12. Content you contribute
You retain ownership of rights you have in your posts, photos, notes, comments, audio and other submitted content. You must have a lawful right to submit it, and the permissions needed for its intended audience and use. Do not upload private information, identifiable images of others, copyrighted recordings or a child's image without the authorisation or other lawful justification required for that particular use. Permission to take a picture does not automatically include permission to publish it. A person being tagged is not evidence of their approval.
People memories. People memories are public. Each time you publish a People memory, you confirm that you have the permission or other lawful basis needed to publish the identifiable people in it, their tags and your note to a public audience. Once you accept this version, that also applies to the People memories you published before. Emblem does not check that permission. Anyone shown or tagged who did not agree can report the memory or contact us. We will review it and remove it where their rights require.
To operate your chosen features, you grant Emblem a non-exclusive, worldwide, royalty-free licence to host, reproduce, technically process, resize, transcode, format and display that content to the audience you selected, deliver it to your selected recipients, and allow necessary service providers to do so on our behalf. Where you use a supported translation or caption feature, the licence includes the translation or caption necessary for that feature. It also permits the necessary safety and moderation review of the contribution. For content deliberately published publicly, this includes displaying it in public service feeds, profiles, search and service previews with its associated attribution. It does not give us ownership, a right to reveal private content to a different audience, or an unrestricted right to use private content for unrelated advertising or model training.
The licence ends for future active use when the content is removed, except for copies necessary for legal obligations, safety, dispute evidence or limited backup operations. For a gift or message already delivered to your selected recipient, the licence continues only as necessary to maintain that recipient's permitted copy, subject to applicable privacy, image and erasure rights. Removal does not authorise unrelated reuse or override those rights. An independent recipient may also have made a lawful copy that we cannot retrieve. We will not use a retention exception to keep content publicly available without a separate lawful reason. Specific promotional, commissioning or AI-training uses require the applicable separate permission or agreement.
Publicly shared content can be copied or redistributed by others. Privacy controls affect future access within the supported service, but cannot guarantee recovery of a third party's prior copy. That limitation does not relieve Emblem of its duties to restrict its own access and storage.
13. Community rules and prohibited activity
Do not upload or facilitate illegal material; sexual exploitation or abuse; threats; harassment; hate or discriminatory abuse; stalking; doxxing; non-consensual intimate imagery; infringement; deceptive impersonation; scams; malware; or content that endangers children. Respect other users' privacy and choices.
Do not fake location, eligibility, reviews or engagement; exploit payment, reward or referral systems; create accounts to evade a restriction; trade accounts or credits outside permitted features; access another person's account; disrupt the service; bypass rate limits; or extract personal data without permission. Report a vulnerability responsibly rather than exploiting or publicly disclosing personal data.
14. Reports, moderation and reasons
Use the in-app reporting tool or danielmichels@emblemdigitalsouvenirs.com to report unlawful content or a rights violation. Identify the precise link or other electronic location, explain the facts that make the content unlawful, provide your name and email where required, and confirm your good-faith belief that the notice is accurate and complete. The statutory exception to identifying the reporter applies to relevant child sexual-abuse offences. A lack of a formal legal citation does not itself invalidate an understandable report. You do not need an Emblem account to contact us. Do not include unnecessary sensitive data. Requests can be made by the affected person or an authorised representative.
We acknowledge an electronic notice containing contact details without undue delay and communicate our decision and available remedies to the reporter. We inform the reporter when automated means were used to assess or decide their notice. Notices are assessed diligently, objectively and without arbitrary treatment. We can investigate, restrict visibility, remove content, reject a collection or transaction, limit a feature, suspend an account or terminate access for a substantiated breach, legal obligation, serious safety concern or documented security or service-availability risk. Automated eligibility, anti-abuse and validation controls may assist those actions. A technical validation failure alone is not proof of deliberate wrongdoing. We assess context and proportionality and can use human review where appropriate.
For content restrictions covered by the Digital Services Act, we provide the affected person with the required clear and specific reasons at the time the restriction is imposed, subject to the applicable statutory exceptions. The notice identifies the action and its scope/duration, relevant facts, whether it followed a report or our own investigation, automated detection or decision-making where used, the legal or contractual ground and available remedies. The reporter’s identity is disclosed only where strictly necessary. Any restriction of required disclosure must have a specific legal basis; an investigation alone does not grant a general right to withhold reasons. For other account or eligibility actions, we also explain the reason and challenge route where required or appropriate. Send a challenge with the decision reference and supporting facts to our contact address; we will assess it in good faith. This does not replace any statutory complaint or judicial remedy.
15. Suspension, closure and account deletion
We may act immediately against urgent threats, serious unlawful activity, fraud or a legal requirement. For a remediable breach we will normally give a reasonable opportunity to correct it. We can also end or materially reduce a service for a genuine operational reason, with reasonable notice where practicable and the remedies required for paid services.
You can stop using Emblem or request account deletion in settings. The app currently schedules deletion after a 30-day grace period; signing back in during that period can cancel the request. An urgent data-rights request can instead be sent directly to us. The Privacy Policy explains necessary retention and deletion limits. Cancel any auto-renewing store subscription separately.
On closure, rights to use restricted service features cease. We may remove invalid collections or benefits directly attributable to a proven breach. Properly paid rights, balances, refund claims and statutory remedies are assessed separately; they are not automatically forfeited for every breach. Necessary provisions on outstanding payments, retained evidence, intellectual property, liability and dispute resolution continue to apply to the extent relevant and lawful.
Where consumer digital-content or service law gives you a right to retrieve content you supplied or created following termination, we provide that applicable content on request, without charge or hindrance, within a reasonable time and in a commonly used machine-readable format. This includes qualifying nonpersonal content as well as the personal data governed by privacy law, subject to the specific statutory exceptions. We do not treat GDPR portability as the only possible retrieval right. Ask our contact address to arrange retrieval; required preservation or retrieval must be assessed before the relevant content is irreversibly removed.
16. Service and terms changes
We may make changes for valid reasons such as security, legal compliance, fraud prevention, interoperability, supported-device changes, correction of errors, a documented licence expiry or documented changes necessary to maintain service availability or economic viability. We will explain material changes and their effective date through an appropriate notice. Changes do not apply retrospectively to extinguish accrued rights or claims.
For a continuing consumer digital service, changes beyond those needed to maintain conformity must meet the applicable legal conditions and be made without additional cost to you. Where a change adversely affects access or use more than minimally, we will give the required advance notice on a durable medium and the applicable right to end the contract without charge, including the statutory 30-day period running from receipt of the notice or implementation of the change, whichever is later, where it applies. Where the law permits an unchanged-service alternative, that version must remain compliant and available without additional cost. A notice that merely tells users to check the website regularly is not a substitute.
When a change needs new acceptance, we will request it before applying the affected new agreement. We will not use acceptance of revised terms to force consent to optional processing. Price or renewal changes follow the applicable store process and mandatory consumer protections.
17. Availability and warranties
We use reasonable care to provide the service as described. Temporary interruptions may occur for maintenance, outages or circumstances outside our reasonable control. We will take reasonable steps to address defects and disruptions within our responsibility. Third-party information and cultural interpretations can be incomplete; use appropriate judgement and report inaccuracies.
For consumers, all mandatory guarantees, conformity obligations, update duties and remedies remain in force. For business users only, and to the extent permitted by law and any specific agreement, the service is provided without an additional warranty that it will be uninterrupted, suit every special purpose or generate a particular business result. This clause does not contradict an express promise in the applicable offer.
18. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable consumer rights, fraud, wilful misconduct, gross negligence where exclusion is prohibited, or death or personal injury caused by negligence where protected by law. It does not restrict a data subject's statutory rights to compensation.
For consumers, we remain liable in accordance with applicable law. We do not impose a blanket monetary cap or exclude every category of loss irrespective of fault. We are not responsible for losses arising solely from your own unlawful act or an independent third party where the law does not attribute responsibility to us.
For business users only, subject to the preceding exceptions and unless a separate written agreement expressly provides otherwise, our aggregate liability for claims arising in a contract year from the affected service is limited to the greater of EUR 100 and the fees the business paid to Emblem for that service in the 12 months before the event giving rise to the first claim in that year. A contract year is a successive 12-month period from the start of the business contract. Claims arising from the same event or a related series of events are allocated to the year of the first event; they do not create multiple caps by spanning years. To the extent lawful, we exclude business loss of profit, revenue, opportunity, goodwill and indirect or consequential loss.
19. Business indemnity
For business users only, if your culpable breach of these terms, unlawful submitted content or violation of a third party's rights causes a third-party claim against Emblem, you must reimburse the reasonable losses and defence costs directly attributable to that conduct to the extent permitted by law. We will notify you promptly, allow reasonable participation in the defence and take reasonable steps to limit loss. You are not liable under this clause for Emblem's own fault, an unauthorised settlement or matters outside your responsibility. Consumers have no general indemnity obligation under this clause.
20. Law and disputes
Luxembourg law governs these terms, subject to any mandatory protection that applies to a consumer in their country of habitual residence. Consumers retain the courts and remedies available under applicable law, including a competent court at home where that law provides. These terms contain no mandatory arbitration or class-action waiver.
Please contact us first if you want help resolving a complaint; doing so does not prevent urgent or timely legal action. Luxembourg's Service national du Médiateur de la consommation provides an available route for eligible consumer disputes: https://mediateurconsommation.lu/. Participation and admissibility follow its rules and applicable law. We do not promise compulsory participation in a scheme to which we have not committed. The former EU Online Dispute Resolution platform is no longer a current complaint route.
For business users only, unless an applicable written agreement states otherwise, the competent courts of Luxembourg City have exclusive jurisdiction, subject to any mandatory jurisdiction rule.
21. General provisions
We may transfer the service or agreement in a legitimate reorganisation or business transfer, with any required notice and protection of personal data. Such a transfer must not remove accrued consumer rights or materially reduce contractual protection without the remedy required by law. You may not transfer an account or agreement without permission, except as mandatory law permits.
If a provision is unenforceable, the remaining terms apply to the extent lawful; an invalid clause is not automatically replaced by the most restrictive possible version. Delay in enforcing a right does not by itself waive it. No clause gives an unrelated third party an enforceable right unless expressly stated or required by law. These terms and the applicable offer form the ordinary user agreement; a specific signed project agreement can contain different provisions for that project.
